臺灣依農業發展條例之規定，農業用地上興建有固定基礎之農業設施，應先申請農業設施之容許使用，政府並定有「申請農業用地作農業設施容許使用審查辦法」作為執行依據。其中，由於考量再生能源為乾淨綠能，亦為國家政策鼓勵之方向，故將太陽能、風力及非抽蓄式水力設施等綠能設施，亦允許納入農業用地上以容許使用之方式設置。此外，該辦法並規定嚴重地層下陷地區、污染控制場址、污染整治場址或污染管制區之農業用地設置綠能設施，可以不必檢附與農業經營使用相結合之經營計畫，其立法意旨主要係考量該類土地生產力相對偏低，甚至無法作農耕使用，為活化此類邊際土地以有助農地多元利用，並適度回饋於農民收益。...
